Based on the most recent figures released from CrimeAmerica, there were 1,212 reported violations of the Federal Bank Robbery and Incidental Crimes Statue during the third quarter of 2009. According to statistics released today by the FBI, there were 1,184 robberies of financial institutions, and 28 burglaries reported between July 1, 2009 and September 30, 2009. Highlights of the report include:
  • Money was taken in 90 percent of the incidents, totaling more than $9.4 million.
  • Of the money taken, 22 percent of it was recovered. More than $2.2 million was returned to financial institutions.
  • Bank crimes most frequently occurred on Friday. Regardless of the day, the time frame when bank crimes occurred most frequently was between 9:00 a.m. and 11:00 a.m.
  • Acts of violence were committed in 5 percent of the incidents, resulting in 26 injuries, five deaths (perpetrators), and 32 persons being taken hostage.
  • The most common methods used were oral demands, closely followed by demand notes.
  • Most violations occurred in the southern region of the U.S., with 492 reported incidents.

This is an important decision for the retail and e-commerce industries.Lenders engaged in e-commerce should consider complying with FACTA’s credit card truncation requirements simply as a matter of good business practice, but court rules in creditor’s favor.

FACTA does not apply to e-mail order confirmations
In Shlahtichman v. 1-800 Contacts, No. 09-4073, slip op. (7th Cir. Aug. 10, 2010), the 7th Circuit held that the credit card truncation requirements of the Fair and Accurate Credit Transactions Act of 2003 (FACTA) do not apply to e-mail order confirmations.

While the decision strictly applies only within the 7th Circuit (Illinois, Indiana and Wisconsin), as the first and only appellate court decision on the issue, it will carry persuasive effect elsewhere.

Fair Credit Reporting Act preempts portion of California Credit Reporting Act
On August 18th, the Ninth Circuit held that the federal Fair Credit Reporting Act preempts a California statute governing how consumer credit reporting bureaus investigate and report a disputed credit report.

Credit card interest rates soared in the second quarter to a nine-year spike, according to the market research company Synovate.
The average interest rate on existing cards jumped to 14.7% last quarter, up from 13.1% a year earlier, Synovate said. Synovate is the market research arm of Aegis Group plc.
